INTRODUCTION & ELIGIBILITY
By accessing, browsing, registering an account, or making any purchase on lojavibeanimal.com (the “Site”), you (“you,” “your,” or “User”) explicitly agree to be bound by these Terms of Service (“Terms”) and all applicable laws and regulations. These Terms constitute a legally binding agreement between you and VibeAnimal (“VibeAnimal,” “we,” "us," or “our”). If you do not agree to these Terms, you must not access the Site, use our services, or complete any transaction.
By using the Site or purchasing products, you represent and warrant that: (a) you are at least eighteen (18) years of age and have full legal capacity to enter into these Terms; or (b) if you are under eighteen (18) years of age, you are using the Site only with the knowledge and verifiable consent of a parent or legal guardian, who accepts these Terms on your behalf and assumes full responsibility for your use of the Site and any purchases made. If you are accessing the Site on behalf of a business or other legal entity, you represent that you have authority to bind that entity to these Terms.
You also acknowledge that your use of the Site is subject to all applicable U.S. federal, state, and local laws and regulations, including but not limited to Federal Trade Commission (FTC) guidelines, the California Consumer Privacy Act (CCPA) as applicable, and the Children’s Online Privacy Protection Act (COPPA) where relevant.
ONLINE STORE TERMS & PRODUCT ACCURACY
VibeAnimal operates a premium online pet store offering products, accessories, and related items for pets. All products and services offered on the Site are subject to availability, and we reserve the right to limit quantities, discontinue any product, or refuse any order at our sole discretion.

We expressly reserve the right, at any time and without prior notice, to: (a) Refuse service to any person, entity, or account for any reason permitted by law; (b) Cancel or limit quantities on orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors, or that otherwise violate these Terms; (c) Modify, suspend, or discontinue any product, service, price, promotion, or content on the Site.
We strive to display products, descriptions, and prices as accurately as possible. However, we do not warrant that product descriptions, pricing, availability, or other content on the Site are accurate, complete, reliable, current, or error-free. In particular, while we make commercially reasonable efforts to display product colors and images accurately, we cannot guarantee that your device’s display of any color or detail will be accurate, as this depends on your monitor, screen settings, and hardware.

In the event of an error in pricing, description, or availability, we reserve the right to correct such error and to revise or cancel any order placed based on incorrect information, even after the order has been submitted or confirmed, to the extent permitted by law.
INTELLECTUAL PROPERTY
All content on the Site, including but not limited to text, graphics, logos, icons, images, product photos, videos, audio clips, digital downloads, data compilations, software, and the overall look and feel of the Site (collectively, “Content”), is the exclusive property of VibeAnimal or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

Without limiting the foregoing, the VibeAnimal name, logo, trade dress, domain name (lojavibeanimal.com), and all related names, designs, and slogans are trademarks or service marks owned or licensed by VibeAnimal. All other trademarks, product names, and company names or logos mentioned on the Site are the property of their respective owners.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site and its Content solely for your personal, non-commercial use in connection with browsing and purchasing products from VibeAnimal. You may not copy, reproduce, modify, distribute, transmit, display, perform, publish, license, create derivative works from, or otherwise exploit any Content, in whole or in part, without the prior written consent of VibeAnimal or the applicable rights holder.

Any unauthorized use of the Site or Content automatically terminates the license granted by these Terms and may violate applicable laws.
RETURN & REFUND POLICY INTEGRATION
VibeAnimal is committed to customer satisfaction while maintaining clear and fair policies. Subject to the conditions below, customers have a strict fourteen (14) day return window.
(a) Return Window: You have exactly fourteen (14) calendar days from the date of delivery (as indicated by the carrier’s tracking information) to request a return or refund. Requests made after this 14-day period will not be accepted, except where required by applicable law.

(b) Condition of Items: To be eligible for a return or refund, products must be unused, unwashed, undamaged, and in their original packaging with all tags, accessories, manuals, and components included. For hygiene and safety reasons, certain items (such as grooming tools, feeders, or items that come into direct contact with pets’ bodies or food/water) may be non-returnable once opened, except in cases of defect or damage as determined by VibeAnimal.
(c) Return Process: To initiate a return or refund request, you must contact us at support@vibeanimal.com within the 14-day window, provide your order number, proof of purchase, and a clear description of the issue. We may request photos or videos of the product and packaging to assess eligibility.

(d) Approval & Refunds: If your return is approved, we will provide instructions for returning the item. Unless otherwise stated, you are responsible for return shipping costs. Once we receive and inspect the returned item, we will notify you of the approval or rejection of your refund. Approved refunds will be processed to your original method of payment within a commercially reasonable time, subject to your bank or payment provider’s processing times.
(e) Non-Delivery, Defective, or Damaged Items: If an item is not delivered, arrives defective, or is damaged in transit, you must notify us at support@vibeanimal.com within a reasonable time after the expected delivery date or receipt of the item. We may, at our sole discretion and as permitted by law, offer a replacement, store credit, or refund.

This return and refund policy is incorporated into and forms part of these Terms. Additional details or exceptions may be provided on specific product pages or during checkout, and in the event of a conflict, those specific terms will control for that product.
THIRD-PARTY LINKS & FULFILLMENT
VibeAnimal utilizes specialized global partner networks, suppliers, and fulfillment providers to source, process, and ship goods directly to consumers. As a result, products may be shipped from various locations and may be subject to different shipping times, carrier policies, and customs or import rules, where applicable.

The Site may contain links to third-party websites, applications, tools, or services that are not owned or controlled by VibeAnimal (collectively, “Third-Party Services”). These may include, without limitation, payment processors, social media platforms, analytics providers, marketing tools, or external product or content providers.

You acknowledge and agree that: (a) VibeAnimal is not responsible for examining or evaluating the content, accuracy, legality, or practices of any Third-Party Services; (b) VibeAnimal does not warrant and will not have any liability or responsibility for any third-party materials, websites, products, services, or actions; (c) Your use of Third-Party Services is at your sole risk and is subject to the terms, conditions, and privacy policies of those third parties.
Any complaints, claims, concerns, or questions regarding Third-Party Services should be directed to the relevant third party. VibeAnimal is not liable for any loss or damage arising from your use of or reliance on any Third-Party Services, except where such liability cannot be excluded under applicable law.
LIMITATION OF LIABILITY & DISCLAIMER OF WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE, ALL CONTENT, AND ALL PRODUCTS AND SERVICES PROVIDED BY VIBEANIMAL ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

WITHOUT LIMITING THE FOREGOING, VIBEANIMAL EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT of COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL VIBEANIMAL, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH (A) YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SITE OR ANY PRODUCTS OR SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY; (C) ANY CONTENT OBTAINED FROM THE SITE; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF VIBEANIMAL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT ANY LIABILITY IS NOT LAWFULLY EXCLUDED, THE TOTAL AGGREGATE LIABILITY OF VIBEANIMAL AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE OR PRODUCTS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO VIBEANIMAL FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100.00).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES OR WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH CASES, VIBEANIMAL’S LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
GOVERNING LAW
These Terms, your use of the Site, and any separate agreements whereby we provide you products or services shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law principles.

You agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any products or services provided by VibeAnimal shall be brought exclusively in the state or federal courts located in the State of Delaware, and you hereby consent to the personal jurisdiction and venue of such courts, to the extent permitted by law.
CHANGES TO TERMS OF SERVICE
VibeAnimal reserves the right, at any time and in its sole discretion, to update, modify, or replace any part of these Terms. We may do so by posting the revised Terms on this page and updating the “Last Updated” date above. Any changes are effective immediately upon posting, unless otherwise stated.
